STALLION SERVICE CONTRACT

 

This STALLION SERVICE CONTRACT for the 20        breeding season is made and entered into on this                 Day of                                   , 20           ,   between Messick Quarter Horses at Pine Ridge Acres,L.L.C., in Ceresco, Nebraska and hereinafter designated Stallion Owner, and                                        ,  hereinafter designated Mare Owner.  Mare Owner agrees to breed the Mare,                                                Breed                 , Reg. No.                                  ,  to the Stallion GRAND DUKE OF ASSET, AQHA #3611244, for the Stud Fee of $500.00, with live foal guarantee, subject to the following conditions:

 

                1.  A non-refundable Booking Fee of $100.00 is payable at the time of signing this Stallion Service Contract and a Mare’s Health Form, with the balance of $400.00 due when the mare arrives for breeding or before cooled semen is shipped.  All mare and veterinary fees are due before the mare is removed from the facility.  Messick Quarter Horses require 24 hours advance notice before the Mare Owner removes his/her  mare(s) from the facility.

 

                2.  A Breeder’s Certificate will be issued to Mare Owner after all expenses have been paid in full and upon notification of the birth of a live foal.

               

                3.  The Stallion Owner agrees to try and settle the above named mare and has the Owner’s permission to  determine the best method of breeding  such mare.  If the mare does not settle, the Stallion Owner is not held liable.  There is no guarantee of a live foal if the mare leaves the  premises where she was  bred before being checked safe in foal by a certified veterinarian.

 

                4.  The Mare Owner agrees that the above named mare is in a healthy and sound breeding condition and is free from any infection or disease.   Any mare checked by the certified veterinarian and determined to  be, in his opinion, not in sound breeding condition, will not be bred, unless treated and determined  by the certified veterinarian to be in a breedable condition.  The Mare Owner may substitute another mare within the breeding season.  If the above named mare shall die during the breeding season, the Mare Owner shall substitute another mare to breed to the above named Stallion if agreed upon by both the Stallion Owner and the Mare Owner.  Mare must be halter broke.

 

                5.  Mare, and any foal, shall have current vaccinations and be wormed within 30 days of entering the premises of breeding.  Mares from outside the state of Nebraska need to have a health certificate, signed by a certified veterinarian, and a current negative Coggins test listed on the health certificate.  Vaccinations and worming schedules, and, if applicable, Coggins result,  need to be listed on the Mare’s Health Form.

 

                6.  “Live Foal Guarantee” means that the foal shall stand and nurse.  If the mare does not settle, aborts her foal, or the foal is stillborn or non- viable, a service for the following breeding season will be guaranteed, providing immediate notification is given and a written certificate by a certified veterinarian within 7 days that the mare has aborted or had a stillborn foal. A three series  vaccination of the rhinopneumonitis vaccine must be administered at 5, 7, and 9 months of pregnancy.   Failure to do either of these stipulations will void this live foal guarantee.

 

                7.  It is further agreed that should the above named Stallion shall die, or become unfit for service, (determined by a certified veterinarian), the Mare Owner may breed the above named mare to another Stallion on the farm, if agreed to by both the Mare Owner and the Stallion Owner, or the balance of  the Stud Fee, after Mare Owner expenses, will be refunded.

               

                8.  Waiver of Liability:  It is understood that Messick Quarter Horses at Pine Ridge Acres, Brenda and/or Thomas Messick, and /or Employees shall not be held liable for any accident, injury, loss, damage sickness to and/or death of the above named horse, owner and/or participant in  equine activities resulting from the inherent risk of equine activities and/or to any damage to and/or loss of owner’s personal property. Owner, or legal guardian,  is responsible for full and complete insurance  coverage on the owner, above named horse, and/or personal  property.

 

                 9.  This Stallion Service Contract  entered into the State of Nebraska and will be enforced under the  laws of Nebraska.  If any clause in this contract is against Nebraska law, then that clause only  shall be null and void.  This Stallion Service Contract is non-assignable and non- transferable.  This Stallion Service Contract represents the entire agreement between the parties.  No other agreement or promise, verbal or implied, is enforceable unless stated in this written Stallion Service Contract.  When Stallion Owner and Mare Owner sign this Stallion Service Contract, and this signed Stallion Service Contract, along with a copy of both sides of the above named mare’s registration papers, a Mare Health Form, and $100 non-refundable deposit is received by Messick Quarter Horses, then it is  binding on both parties.

 

                10.  The Breeding Season for this Stallion Service Contract shall begin March 1, 20         and shall close June 30, 20         .
